Terms and Conditions 


Pukket enables business to turn their customers into their super advocates on social media. We do this by automatically identifying these customers on social media channels, onboarding them, engaging them and finally rewarding them for the word-of-mouth and pieces of content they have generated. This allows brands to build and engage in a meaningful relationship. 


Pukket is operating under our legal company name “Pukket Limited” based in London, UK.

By using Pukket mobile app, web app on www.pukket.app, or accessing the content through our website www.pukket.com, you agree to follow these rules. Please be sure to read our privacy policy on this page. Pukket reserves the right to update these terms at any time.

Everything listed here apply to everyone interacting with Pukket app (the “App”) or our website on www.Pukket.com. Further below are additional rules that apply to those of you who interact with brands or accept sponsor content on your profile.

Pukket Terms for Users

“Brand” means the Social Media Account invited you to join their community;

“Brand Content” means any images, logos or other material of any kind provided by the Brand to the User;

“Content” means any images, video, text, drawing or any other material created or shared by the User in a Post which references the Brand;

“Intellectual Property Rights” means patents, rights to inventions, copyright and related rights, moral rights, trade marks, business names and domain names, rights in get-up and trade dress, goodwill and the right to sue for passing off or unfair competition, rights in designs, rights in computer software, database rights, rights to use, and protect the confidentiality of, confidential information (including know-how and trade secrets) and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world;

“Post” means a social media post posted by you pursuant to this Agreement; and

“User” means you.

  1. In consideration for the opportunity to receive Pukket Points, you hereby grant to the Brand a fully paid-up, worldwide, exclusive, royalty-free, fully sub-licensable, perpetual licence to use, edit, publish, share and otherwise deal with the Content for any purpose, including but not limited to use on their website, social media platforms, marketing and advertising.
  • You agree to do such acts and execute such documents as the Brand may reasonably require to vest in or confirm all rights granted by you to the Brand under this Agreement.
  • You warrant and represent that:
    • You are the sole legal and beneficial owner of, and you own all the rights (including Intellectual Property Rights) and interests in, the Content;
    • You are not licensed or assigned the Intellectual Property Rights in the Content; and
    • The Content is your original work and it has not been copied wholly or substantially from any other source.
  • You, being the sole author of the Content, waive all moral rights in respect of the use to be made of the Content under this agreement to which you may now or at any future time be entitled under the Copyright, Designs and Patents Act 1988 or under any similar legislation from time to time in force anywhere in the world.
  • You agree that the Brand is a third party beneficiary under this Agreement and the Brand may enjoy all rights granted to it under paragraph [1] above, including the ability to enforce those rights against you directly.
  1. The Brands may provide you their own Brand Content to use in your Posts.  The Brand, or their licensors, shall retain ownership of the Intellectual Property Rights in all Brand Content and you agree that you will use the Brand Content solely in accordance with instructions provided by the Brand.

Addressing Users: Be Your Creative Self

  • We will not tolerate any expressions of hate, or even a lack of respect toward ethnicities, religions, cultures, sexual preferences or genders. Pukket is based on the expression of love. If you are not nice we will ask you to leave by revoking your access to Pukket.
  • To maintain a healthy community, some rules are necessary. If someone isn’t following these rules, we may warn them and we may ask them to leave by revoking access to Pukket (if you do something really bad we will ask you to leave without a warning). We may have to make difficult decisions in balancing freedom of expression against the requirement to be nice as explained before and this is where we ask that you trust us to be fair. We reserve the right to update these rules and terms without notice. Your continued access of our service after those changes demonstrates your acceptance of those changes.
  • We make sure our partner brands reward you accordingly for your performance. Most importantly, Pukket is intended to be the place where everyone should share their love and respect for others. Pukket allows links to external content and websites: please know that we are not responsible for the content associated with those links.
  • You must be 13 to use Pukket app or to access the content through our website. If you are over 13 but under 18, you must have the permission of your parent or guardian.
  • You are responsible for the content that you post. Don’t do things that are inappropriate or offensive. If your content is potentially hurtful or offensive to others, don’t post it publicly and only share it with your friends. Don’t do anything illegal with our platform, even with private posting. Don’t use other people’s names, including other potential Influencers. And because people as young as 13 are allowed to use the app, do not post pornography. If you break the law while using Pukket (such as copyright, slander, violating our privacy policies or these rules or trying to sell illegal things or things that don’t belong to you), Pukket is not liable for your actions or your content– you are – and we will ask you to leave by revoking your access and if appropriate, reporting you to the appropriate legal authorities.
  • If you have a problem with us, contact us (support [at] Pukket.com) and we will do our best to be reasonable and fair. For any true legal disputes that arise, you agree to use binding arbitration in London, UK. If you are not familiar with arbitration, it is a very common method to resolve disputes efficiently without involving the court system.

Pukket’s Terms of Use for Content and Monetization:  

When you first sign up and register a new user profile with Pukket, you agree to participate in the process of including brands in your posts. By doing so, you agree to the following additional terms and conditions:

  • Defined words and phrases. As above, we refer to our company as “Pukket” . All users of Pukket, which may be either individual people, are referred to as “advocates” including you. If anyone creates an Pukket profile for a fictional character or a non-human individual, such as a pet dog, the person controlling the account and profile is agreeing to these terms and is included in the definition of Influencers.
  • Content Eligible for Monetization:
    • First, remember that you need to meet the criteria of each brand campaign in order to be eligible for rewards by them. This may include visual criteria such as product placement, or textual criteria such as hashtags and social handles.
    • Only 1 brand per post is allowed, so please don’t include multiple photos and hashtags within 1 post as it may also restrict your activity up to a week.
    • Posts rewarded should not be deleted from users’ social media feed. Once posted and rewarded it should stay on the profile or we reserve the right to deduct the Pukkets and restrict such users’ activities to protect the interest of those who reward our users.
    • Posts promoting smoking, alcoholic drinks, gambling or nudity are restricted and will be declined as minors may have access to our platform.
  • There are some important industry terms that you need to familiarise yourself for the purpose of understanding monetisation and how our reward system works.
  • Pukket definitions
    • Pukkets: You would be rewarded with Pukket points (“Pukket Points”) for the quality of your posts, the number of engagements it received and the actions users take when interacting with your posts; these Pukket points can then be exchanged for rewards available on our platform.
    • Rewards: Rewards with real monetary value offered by each specific brand
    • Product offers: an offer to purchase a product for a fixed number of Pukket points.
    • All campaigns, offers, rewards and products have a deadline after which they may expire.
    • Consents and Permissions you grant by using Pukkets
      • 1. You expressly grant permission to Pukket, its community of content creators and partner brands access to all information associated with your Pukket profile including but not limited to your profile’s details, posts, data related to your profile and your audience, such as your number of followers, the demographics of your audience and the geographic locations of you and your followers, your content views and measures of popularity such as the rating and likes, as well as the performance of content both inside and outside of Pukket app. You consent to Pukket track, record and then resell data associated with how you use Pukket app. Although we won’t map this data to your name or personal information, it will get mapped to your general demographics so we can track how people interact with the content.
      • 2. You will also be given the opportunity to link the audience data from other social accounts such as Instagram, Facebook and Twitter.
      • 3. You consent to receiving inbound offers from brands related to their campaigns and rewards.
    • Other General Permissions and Consents. As a Pukket User, Pukket has the right to track, record how you use Pukket, including the types of content you view and who views your content.
    • Additional Information about the relationship between you, brands and Pukket:
      • Brands have full discretion to withdraw offers even once accepted based on their determination of the suitability of your profile or your posts.
      • Pukket does not warrant, promise or guarantee any level of ad purchasing or pricing on your content. It is entirely up to you to earn your Pukket points and rewards by having great, engaging content, and building your own audience of followers who regularly view your content to demonstrate to advertisers that their pieces of content will perform well on your content.
      • Pukket does not take any responsibility for transactions taking place between brands (and their vouchers and products) and the users on our platform.
    • Awarding of Pukket
      • The performance of your posts will be based on the quality of the photo/video taken, text as well as the all types of engagements achieved by it. Our artificially intelligent engine will take into account all these factors within the first 24 hours of your post and will award you with Pukkets accordingly.
      • You would be issued with Pukkets after the validation and evaluation stages of your posts after which you can use the coins to make a purchase on our store page.
      • You would need to reach the number of Pukkets required in order to claim a voucher or a product on our store page.
    • Limits of Liability. We are not liable for any lost profits, lost data, lost opportunities, costs of cover, exemplary, punitive, personal injury, wrongful death, special, incidental, indirect or other consequential damages, each of which is hereby excluded. We are obligated to perform only those duties expressly described in these terms and in any agreement between you and any brands. We are not be liable for any error in judgment, for any act taken or not taken, or for any mistake of fact or law, except for our gross negligence or willful misconduct.

Pukket terms of use for brands  

This is an agreement between brands and Pukket with respect to the use of Pukket. In this agreement, You means brands, and we means Pukket. Our agreement includes these terms, our privacy policy, the terms of any advertising campaign a brand submits or modifies and any other terms listed on our website for access to and use of Pukket. Our company’s name is Pukket Limited. We are based in London and are organized as a corporation in the UK. We also refer to our company as “Pukket”.BY ACCESSING AND SIGNING UP FOR PUKKET, YOU AGREE TO THESE TERMS.

  • How it works
    • Using Pukket, brands will be able to establish a deeper connection with their customers and reward those who create content for them on social media platforms. Brand customers share their brand experiences and in return provide a word-of-mouth marketing avenue for brands in an authentic way. In return, brands offer a range of rewards, including vouchers, giftcards or products to them.
    • Pukket Definitions.
      • Types of brand offers: – brands can provide vouchers of different financial value or products with financial value in return for Pukkets which can be added to their campaigns and given to users based on their post performance. Pukket will automatically and intelligently calculate each post’s influence and deduct coins from a campaign and award them to content creators (i.e. users). This calculation will be based on 
  • Post Visual Quality
  • Post textual quality and hashtags
  • Engagements such as clicks, likes, comments, shares, reposts and CPA.
  • “Brand Content” means any content of any nature provided by the Brand in relation to this Agreement
  • “Pukket Platform” means the platform hosted on Pukket’s software applications used to implement and use the Pukket Services
  • “Intellectual Property Rights” means patents, rights to inventions, copyright and related rights, moral rights, trade marks, business names and domain names, rights in get-up and trade dress, goodwill and the right to sue for passing off or unfair competition, rights in designs, rights in computer software, database rights, rights to use, and protect the confidentiality of, confidential information (including know-how and trade secrets) and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world
  • “Pukket Services” means the provision of services as envisioned by this Agreement
  • “Third Party Sites” means a social media platform
  • “Users” or “Influencers” means the Pukket users who will generate content
  • “User Agreement” means the agreement between Pukket and the Users
  • User Content” means any content created by the Users as envisaged by this Agreement and the User Agreement
  • Permitted Uses
  • Our Rights: We may, on prior notification to the Customer  reject, remove, request modification by the Customer, suspend or restrict any campaigns or other materials submitted, to comply with any of our policies or those of any Third Party Site, or as we otherwise determine to protect our interests. Third Party Sites may also be entitled on prior notice to the Customer, to reject, request modification by the Customer or withdraw ads placed under this Agreement to comply with their policies. Subject to the foregoing, neither Pukket nor any Third Party Site will have any liability to you because they exercised these rights.
  • Prohibited Uses of Pukket. You may not use Pukket or any Third Party Site to:
    • generate, manipulate or otherwise produce or induce fraudulent impressions of or fraudulent clicks on computer generated search requests, or fraudulent or deceptive use of other search engine optimization services or software;
    • include content in ads, or use Pukket in any way, which violates or infringes on any intellectual property rights;
    • include content which is threatening, libellous, defamatory, obscene, scandalous or inflammatory or otherwise violates applicable law;
    • include content that is or may be false, misleading or deceptive;
    • advertise goods or services that are illegal in any jurisdiction;
    • advertise goods or services that violates any policy posted on Pukket or any Third Party Site;
    • engage in any other illegal or fraudulent business practice under the laws of any jurisdiction where you are located or the ad is displayed or any other conduct that Pukket or any Third Party Site determines may otherwise result in legal liability;
    • include links to any web site as part of your ad unless the content found at that web site is relevant to your ad;
    • run multiple ads linking to the same or similar web site on the same search results page;
    • use spiders, robots or other automated data mining techniques to catalog, download, store or otherwise reproduce or distribute information available on Pukket;
    • take any action to interfere with Pukket or any other user’s use of Pukket; or
    • frame portions of Pukket within another web site or establish links from any other web site to any page of Pukket other than the home page.
    • We are an ethical marketing startup and reserve the right not to serve brands in the alcohol, gambling, betting, sex etc.
  • Passwords and Authority: 
    • We will authorize IDs and passwords and may revoke them if you violate this agreement. Upon requesting a password, you may be required to provide information regarding you or your organization. Please safeguard your ID and password. You are responsible for telling us if there is a change of the responsible personnel in possession of an ID and password. We may monitor the logon times and usage under each ID for the purpose of verifying that you are the sole holder and user of the ID and to verify compliance with this agreement. If any party under your control gains access to Pukket through use of the ID or by circumventing Pukket’s security systems, you remain liable to Pukket. If you are accessing Pukket on behalf of a business entity, whether as an employee or agent, you represent that you have the legal capacity and authority to bind that business entity to this agreement. The term “you” refers both to the individual accessing Pukket on behalf of a business entity, if any, and that business entity itself.

INTELLECTUAL PROPERTY

  • In relation to any Brand Content:
  • The Customer and its licensors shall retain ownership of all Intellectual Property Rights in the Brand Content; and
  • The Customer grants to the Supplier a fully paid-up, non-exclusive, royalty-free, non-transferable licence to use the Brand Content for the term of this agreement for the purposes of providing the Pukket Services.
  • For the term of this Agreement, Pukket grants to the Customer a limited, non-exclusive, nontransferable royalty free license to use the Pukket Platform on one computer at a time[CS1] , for your own internal business purposes and solely to participate in Pukket with the intention of placing or accepting offers of content generation. The Customer may not modify or create derivative works based on the Pukket Platform. Pukket retains ownership of all Intellectual Property Rights which subsist in the Pukket Platform and Pukket’s software.
  • The Pukket Platform and everything used in connection with it, are owned, or authorized for use, by Pukket, except for Third Party Sites, which are subject to the terms of use posted on those sites. Except as expressly permitted, you may not modify, copy, reproduce, republish, upload, post, transmit, or distribute any part of the Pukket Platform. Each User, or the User’s licensors, retains ownership of any Intellectual Property Rights which subsist in the User Content.
  • The Customer may provide Users with content to use, like a logo or image. 
    • The Customer or its licensors will retain ownership of any Intellectual Property Rights which subsist in the Brand Content.
    • The Customer grants a fully paid-up, non-exclusive, cancellable, royalty-free, non-transferable licence to use the Brand Content specifically in accordance with the Customer’s instructions in order to generate the User Content
  • Pukket:
    • warrants that the receipt, use and supply of the Pukket Services and the Pukket Platform (excluding the Brand Content) by the Customer shall not infringe the rights, including any Intellectual Property Rights, of any third party; and
    • shall indemnify the Customer in full against all liabilities, costs, expenses, damages and losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other professional costs and expenses) suffered or incurred by the Customer arising out of, or in connection with, the receipt, use or supply of the Services, the Pukket Platform and the User Content  (excluding the Brand Content).
  • Communications Solely With Pukket. You agree to communicate solely through Pukket regarding campaigns, and agree not contact Influencers directly with an effort to avoid paying our Fees. If within a period of six months following termination or expiry of this agreement, you engage in campaigns directly with Influencers who you initially connected to through Pukket, we reserve the right to collect our fee on all future transactions between you and that Influencer.
  • Privacy and Data Collection. We do not collect personally identifying information from you unless you have voluntarily given such information to Pukket (for example, when registering to become a brand or when sending us an e-mail or other submission). For further information about how we use information collected from you, please view our Privacy Policy. Unless otherwise provided in the Privacy Policy, any communication you transmit to us is non-confidential.
  • Ad Responsibility. Brand sponsors are solely responsible for selection of all advertising content and other matters (including keywords, categories or other targeting mechanisms), content and integrity of ads, including URL links, and all transactions consummated as a result of those ads. We may review or screen the content of any ad.
  • Termination; Cancellation. Either party may, in it’s sole discretion, immediately terminate this agreement, or cancel or suspend any campaigns, ads or generated contents. The terminating party shall provide prior notice of such termination to the other party.
    • If we terminate this Agreement because you breached this Agreement, we are not required to refund any pre-paid or unused portions of your budget. If you terminate this Agreement because we breached this Agreement, you are not required to pay any outstanding portions of your budget .
    • Brands may cancel or delete any ad or terminate this Agreement by changing the end date or deleting the campaign. We will use our reasonable efforts to take these contents and campaigns down, or tell Influencer to remove the ad or post, but you acknowledge that once posted, we have no control over Influencer’s behavior.
    • Upon cancellation of any ad or termination of this Agreement, brands are still responsible for any amount due for ads placed through the date such cancellation or termination takes effect, as well as any related hosting or other expenses.
    • Any unused budget for Sponsors will then be refunded.
  • Payment. You agree to pay all applicable charges detailed under this agreement or on any form on Pukket, including any applicable taxes or charges. You are required to deposit the amount agreed to upon sign-in, and the balance will be used to fund ad purchases. Except as provided under “Termination or Cancellation” we will refund any unused balance upon request. We may change pricing policies upon notice to you at any time. If you dispute a charge or payment, you must notify us in writing within sixty (60) days of the charge or payment stating the nature of such dispute. We calculate charges based on our records. No other measurements or statistics are accepted by Pukket or have any effect on pricing terms or decisions. You are responsible for all reasonable expenses (including attorneys’ fees and costs) incurred by us in collecting unpaid and undisputed amounts under this agreement.
  • Representations and Warranties. You represent and warrant that (i) all information provided by you to enroll in Pukket, or otherwise in connection with any ad, posting or other communication is correct and current, (ii) you will not forge or mask your true identity, or the provider of any goods or services, in any ad, posting or other communication, (iii) you hold all rights to permit Pukket and any Third Party Site to use, reproduce, display, transmit and distribute your ads and content and (iv) use of your ads by Pukket or any Third Party Site will not violate any law, rule, regulation or rights of any third party.
  • No Guarantee. We make no guarantee regarding the levels of impressions or results for any ad on the Pukket or Third Party Site. We may offer the same services to more than one advertiser.
  • No Warranty. Pukket does not guarantee that the operation of Pukket will be uninterrupted, error free or that Pukket and the information it stores will be entirely free from viruses, hackers, intrusions, unscheduled downtime or other failures. You expressly assume the risk of such problems by using Pukket. All software, content, operations and materials, are provided “as is”. Except as specifically provided in this Agreement, we make no representations or warranties.
  • Limits of Liability. Neither party will be liable for any lost profits, lost data, lost opportunities, costs of cover, exemplary, punitive, personal injury/wrongful death, special, incidental, indirect or other consequential damages, each of which is hereby excluded. Each party’s total liability will not exceed three times the total contract value specified in the Order Form . We are obligated to perform only those duties expressly described in these terms and in any agreement between a brand and Influencer. We are not liable for any error in judgment, for any act taken or not taken, or for any mistake of fact or law, except for our gross negligence or willful misconduct.
  • Your Obligation to Indemnify. Each party agrees to indemnify, defend and hold harmless the other party, including their respective employees, directors, officers, agents, representatives and affiliates, from and against all claims, demands, liabilities, costs or expenses, including reasonable attorney’s fees and costs, arising from, or related to, any breach by one party of any applicable law.
  • Variation: No variation of these terms shall be effective unless it is agreed by the parties in writing. Severability: If any part of this Agreement is declared to be invalid or unenforceable by any court of competent jurisdiction, that provision will be ineffective but will not affect any other part of this Agreement. The invalid portion of any provision will be deemed modified to the least degree necessary to remedy such invalidity while retaining the original intent of the parties.
  • Waiver; Remedies: Either party’s failure to partially or fully exercise any rights or waiver of any breach of this agreement by a party, will not prevent subsequent exercise of that right or be deemed a waiver by either party of any subsequent breach by the other. Each party’s rights and remedies under this Agreement are cumulative, and each party’s exercise of any right or remedy will not limit that party’s right to exercise any other right or remedy.
  • Third Party Beneficiary; Assignment. Any and all rights conferred to third parties under the ontracts (Rights of Third Parties) Act 1999 are hereby excluded to the fullest extent permitted by law. Either party may assign all, or any part of, it’s rights or obligations under this Agreement to a third party upon providing written notice to the other party. This Agreement shall inure to the benefit of our successors and assigns.
  • International Access: Pukket is provided from the United Kingdom and all servers which make them available reside in the UK or in Europe. We make no representations regarding the legality of Pukket in any other country. You are responsible for ensuring that your use complies with all applicable laws outside of the UK.
  • Governing Law: The laws of the England and Wales  govern this Agreement. YOU HEREBY EXPRESSLY CONSENT TO EXCLUSIVE JURISDICTION AND VENUE IN THE COURTS OF ENGLAND AND WALES.
  • Digital Millennium Copyright Act (“DMCA”) Notice: We are under no obligation to scan ads or content sent through Pukket for the inclusion of illegal content. We do not permit materials known to be infringing to remain on Pukket. You should notify us promptly if you believe any materials on Pukket infringe a third-party copyright. Upon receipt of notice of claimed infringement under the DMCA, we will respond expeditiously to follow the procedures specified in the DMCA to resolve the claim between the notifying party and the alleged infringer by removing or disabling access to materials claimed to be infringing or by removing or disabling access to such materials. If you own a copyright or trademark that you feel has been misappropriated by someone else on Pukket without your permission, please notify us at hey [at] Pukket.com

How Does Pukket Use My Information?

  • establishing and verifying the identity and eligibility of users;
  • opening, maintaining, administering, managing, and servicing users profiles, accounts or memberships;
  • processing, servicing or enforcing transactions (including credit or debit card transactions, gift card transactions, and payments to content creators);
  • providing products, content, content suggestions, services, and support;
  • conducting special events, sweepstakes, surveys, programs, contests, and other offers (and communicating with you about such events);
  • analyzing and improving our products, services, or Website (including developing new products and services; improving safety; managing our communications; analyzing our products; performing market research; performing data analytics; and performing accounting, auditing and other internal functions);
  • providing users with product, service, or company updates;
  • marketing and advertising our products or services as well as products and services of third parties (such as affiliates, subsidiaries, and business partners);
